“It is quite astonishing rather I don’t understand as to why the victims don’t come to the advocates for seeking their assistance as the advocates by invoking the provisions of the law in the respective cases pleaded their case in the court of law. It’s the courts which comes to the rescue of the victims who faces injustice”, Advocate Dheeraj Kour averred.
Adv. Dheeraj Kour accompanied by Adv Sajad Chouhan of Poonch, addressing media persons over recent incident of third degree torture to a cop by Poonch Police, divulged that if some incident reported and for the same FIR stands registered by the Police, adding, two type of offences one is cognizable and another is non cognizable.
“Where as in Cognizable Police has the authority to arrest without warrant and in Non cognizable Police can’t arrest without warrant. Police have the powers to arrest in Thana and whereas those offences which are petty in nature Police can bailed out the accused persons. She cited an example of heinous crime as that of militancy related case where police resorted to torture of the accused so that the accused made confession”, Adv. Dheeraj said shedding light on the powers of the Police and provisions of the law under which police can arrest the accused persons.
Elaborating further, she lamented that as there is a provision of the law where in after the lapse of twenty four hours Police has to produce the accused person before the Magistrate concerned having the Jurisdiction. Magistrate asks Medical of the accused conducted. Magistrate asks for the sole purpose in order to ascertain whether the accused not subjected to the torture in the custody of the Police’, she added.
She further divulged that Police required to follow Police rules. But if Police evict any person without any cause and provocation and beaten him in the custody that is totally illegal and condemnable. We unequivocally and in bold terms condemned it for the reason when it is not enshrined under the law.
“Had Jagvinder not my brother and still someone else become victim of Police atrocities I would defended their case in the court of law”, Dheeraj, vociferously laments. As today in press conference I drew the attention of media towards three persons who were victim of Police excesses. Prior they not came forward. So, they approached to me when they came to know about this shocking incident, shed rued. Even one of the victim told me on the application of domestic violence he had been given electric shock adding rather, it should not be work of Police that on simple application Police evict individual and his Family. This aspect has to be seen by the courts. Then what the Police do they pressurize the parties to enter into the compromise, the lawyer regretted.
Adv. Dheeraj Kour who was simmering with discontent and seething with anger said, “I get astonished when came to know that the victim get electric shock resultant there in he get mentally unstable and suffered forty five percent disability due to which the whole family is in distress.”
She said that our black coat signifies our respect as in courts we defended the cases of our clients. We advocates are voice of voiceless litigants who couldn’t able to defend their cases in the court of the law. They approached us for the reason they thought their atrocities which they confronted at the hands of Police will be highlighted”, she lamented. On being asked by the News portal reporter those victims who approached you are they also victims of Police atrocities, Adv Kour of course they are victims of Police excesses adding, what is baffling none of them prior raked up the issue of excesses of Police. Now they came forward, she added. They also not believed on advocates. That if they faced brutality at the hands of Police then they should go to the advocates in order to get their case filed in court.
She divulged that wherever we sit we thought Police is doing well but when this matter came to fore everyone get astonished about the Police functioning. Advocate Kour recalled that still, there are several ones with whom such torture or treatment meted out but they chose not to come forward.
“We are not supporting any criminal nor supporting any crime. This is not our work rather our work is to defend them in the court of the law. We don’t support that thing of Police which they committed is wrong under the precincts of the law. Adv. Sajad Chouhan who lamented, “We are ready to represent the cases of litigants freely meaning there by we don’t take fees from the litigants. Wherever anyone face injustice they will without any hiccups and hindrance approach us. It is the duty of the advocates to defend the cases of poor ones in the interest of equity, Justice and fair play.”
