Offended over statement of DAP’s spokesperson, the Lawyers from Gujjar community lodged complaint under, Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, at Janipur Police Station
Practising lawyers from Gujjar Bakrwal Community lodged complaint against Democratic Azad Party under SC ST Atrocity Act, in Janipur Police Station of Jammu City.
“We, the applicants belongs to Gujjar Bakrwal community and are citizens of India, therefore reserves all rights enshrined in the constitution of India. Yesterday, (Sunday, 14/05/2023) we came to know about a video circulating on social media where one so-called leader of DAP ‘Sujada Bashir’ uttered some objectionable, in fact discriminatory and racial statement which is based on phenotypical difference while taking media persons in Srinagar. “It is apt to mention here that the accused lady dragged a particular community ‘‘Gujjar Bakarwal” in her political controversy, with which our community has nothing to do, and while addressing she passed Racial comments and said Waqar Rasool and others “Pta nai kis Gujjar Gauon seh nikla hoa hain”, they alleged in the complaint.
The claimed that the statement made by her was completely racial, defamatory and derogatory in nature, as such she intentionally targeted a particular community ‘’Gujjar Bakrwal‘’. “It is significant to mentioned here that it is settle maxim /preposition of law ‘ignorantia juris non excusat’ which means ‘’ ignorance of fact can be an excuse but ignorance of law is not an excuse, therefore it is crystal clear that lady claiming herself leader of mass and spokesperson of DAP is not an ordinary person who’s statement can be taken as casual/ ignored, rather she deserve punishment under special provisions of ST/SC Atrocities Act 1989”, the offended advocates mentioned in their complaint.
“Keeping in view her criminal act of uttering defamatory, derogatory and racial remarks on particular community, she should be booked under Schedule tribe and schedule tribe atrocities act 1989 in the interest of delivering justice to the community at large”, they added in the complaint.
