In a move aimed at upholding public safety and ensuring compliance with legal directives, the District Magistrate, Jammu Sachin Kumar Vaishya, has issued a public notice initiating proceedings under Section 82 of the Code of Criminal Procedure (Cr.PC) and Section 12 of the Public Safety Act (PSA).
According to the Senior Superintendent of Police, two individuals, Gulzar Ahmad alias Lahu and Mukesh Kumar alias Gesha, have been evading arrest despite the issuance of detention orders under the PSA. Gulzar Ahmad, son of Bashir Ahmad, was served with a detention order vide no. PSA 20 of 2022 dated 24.11.2022. However, authorities have established that he is absconding to avoid the execution of the said order.
Similarly, Mukesh Kumar, son of Dillawar Kumar, has been evading arrest following the issuance of a detention order under the PSA vide no. PSA 19 of 2023 dated 01.10.2023. In compliance with Section 12 of the PSA, both individuals have been directed to present themselves before the office of the District Magistrate within 30 days from the date of the public notice.
Failure to comply with this directive will result in appropriate action under section 12(b) of the PSA, which may include imprisonment for a term extending to one year, a fine, or both. The District Magistrate’s office has emphasized the importance of upholding the rule of law and has urged the individuals in question to cooperate with the legal proceedings.
This move by the district authorities underscores their commitment to maintaining public safety and ensuring that individuals who are subject to legal orders comply with the due process of law.
