In the interest of the security of the State, the Jammu and Kashmir Government on Wednesday terminated the services of a doctor, teacher, lab technician, and a Police cop all posted in different districts of Kashmir Valley, under sub-clause (c) of the proviso to clause (2) of Article 311 of the Constitution of India.
Article 311(2) (c) states that if the President or the Governor is satisfied that the retention of a person in public service is prejudicial to the security of the State, his services can be terminated without recourse to the normal procedure prescribed in Article 311(2). Article 311(2) also states that no civil servant shall be dismissed or removed or reduced in rank except after an enquiry in which s/he has been informed of the charges and given a reasonable opportunity of being heard in respect of those charges.
“Whereas the Lieutenant Governor is satisfied after considering the facts and circumstances of the case and on the basis of the information available, that the activities of Mr. Ab. Salam Rather, Laboratory Bearer in Higher Education Department son of Gh. Mohd Rather resident of Yamrach, Yaripora, Kulgam are such as to warrant his dismissal from service,” Government Order No.1414-JK (GAD) of 2023, Dated:21.11.2023 reads. Accordingly, the Lieutenant Governor hereby dismisses Mr. Ab. Salam Rather, Laboratory Bearer in the Higher Education Department from service, with immediate effect.
Meanwhile, in another order, “the Lieutenant Governor is satisfied after considering the facts and circumstances of the case and on the basis of the information available, that the activities of Mr. Abdul Majeed Bhat, Constable in J&K Police son of Wali Mohd. Bhat resident of Kunan, Kupwara is such as to warrant his dismissal from service,” Government Order No.1415-JK (GAD) of 2023, Dated:21.11.2023 reads. Accordingly, the Lieutenant Governor hereby dismisses Mr. Abdul Majeed Bhat, Constable in J&K Police from service, with immediate effect.
“Whereas, the Lieutenant Governor is satisfied after considering the facts and circumstances of the case and on the basis of the information available, that the activities of Mr. Farooq Ahmad Mir, Teacher in the Education Department son of Gh. Ahmad Mir resident of Malik Mohalla, District Kupwara, A/P Usmanabad, District Kupwara such as to warrant his dismissal from service,” Government Order No.1416-JK (GAD) of 2023, Dated:21.11.2023 reads. Accordingly, the Lieutenant Governor hereby dismisses Mr. Farooq Ahmad Mir, Teacher in the Education Department from service, with immediate effect.
“Whereas the Lieutenant Governor is satisfied after considering the facts and circumstances of the case and on the basis of the information available, that the activities of Dr. Nisar-UI-Hassan, Assistant Professor (Medicine), SMHS Hospital, Srinagar son of Ghulam Hassan resident of village Achabal, Sopore, Baramulla are such as to warrant his dismissal from service,” Government Order No.1417-JK(GAD) of 2023, Dated:21.11.2023 reads. Accordingly, the Lieutenant Governor hereby dismisses Dr. Nisar-UI-Hassan, Assistant Professor (Medicine), SMHS Hospital, Srinagar from service, with immediate effect.
