Subject: Backdoor appointment and illegal promotions of Sh. Firdos Ahmed Qazi presently working Deputy as General Manager, -J&K Housing Board Unit-I Jammu.
Respected Sir,
With due respect we beg to submit to yourself for the few lines for your kind consideration and immediate necessary orders so that engineering community may be saved from further harassment and mental torture, due to some influential persons who have been appointed through Backdoor appointments and also promoted illegally step-by-step being an influential person with political background. Mr. Firdos Ahmed Qazi who has been backdoor appointed through his maternal cousin a leader from Kishtwar, who happens to be J&K Congress Vice-President today and Ex. Minister, is known for his corrupt misdeeds. The details of the case are as under:
1. That the said engineer namely Sh. Firdos Ahmed Qazi was initially back door appointed as Research Assistant on consolidated basis @ 3000 per month for a period of three months by Director Science and Technology Civil Secretariat Srinagar vide order number ST/Adm / 110 of 1993 dated 12-07-1993.
2. After a period of three months he was regularised in the pay scale of 2000-60/ 2300/EB/75/3200/100/3500 wide order number ST/ Camp/ 92 dated 4-10-1993 and official was placed on probation for a period of one year with effect from 1-07-93
3. The said official was promoted as a Research Assistant in the pay scale of 2125-75-2800-EB- 100-3600 vide order number ST/ Adm / 9 of 1994 dated 31-01-1 994 and after a lapse of one year the official was regularised in the pay scale of 2125/3600 from the date of his initial appointment i.e with effect from 17-03-1993, and huge amount of arrears were Drawn fraudulently, directly from the state exchequer. It is surprising to note that within a period of one year Sh. Firdos Ahmed Qazi vide order number 19/ ST of 1995 dated 20-3-1995, was regularised in the pay scale of Rs. 2125/3600 from the date of his first appointment without any approval of the departmental promotion committee and arrears were drawn by the Science and Technology department in his favour and senior aspirants were put behind the darkness with hue and cry. And said Engineer got backdoor appointment as well as three promotions in 2 years, and after a period of 1 year. Mr Firdos Ahmed Qazi was sent to Housing and Urban Development Department on deputation wide order number 11/ST/Adm of 1996 dated 14-02-96 of S&T (C) read with government order number 48/H&UD/LSG of 1996 dated 19-02-96 without any concurrence of General Administration Department.
Since Science and Technology Department was not competent to issue the deputation order without concurrence of general Administration Department, The departmental engineers approached to the then concerned Commissioner/Secretary, H&UD namely Sri Amit Kushari Sahib (IAS) against the said order ,who happens to be very close to Mr Firdos Ahmed Qazi, told the deputation of departmental Engineers that they should not be worried about their stagnation on one post, as they claimed that outsiders are being absorbed in our department and they get promotions step by step by unfair means. Since Mr. Firdos Ahmed Qazi was close to Mr Amit Kushari (IAS) then Principal Secretary Housing and Urban Development Department. The concerned Principal Secretary did not respond the request of the deputation and told them that Mr. Qazi has been deputed to H&UD Department for only one year and after the lapse of one year he may be repatriated to his parent department i.e S&T department, and assured them that he has obtained affidavit from him, that he will work in his pay and grade and will not claim any further promotions (photocopy of affidavit enclosed) but it was totally fraud and eyewash, it was just to close the mouths of deserving candidates as the said official Mr Firdos Ahmed Qazi had big political background as his brother in law a MLC was much more influential person than us and his maternal cousin,the then Minister was at helm of affairs and was godfather of Mr. Qazi. It is pertinent to mention here that the said official Mr Fidos Ahmed Qazi after the lapse of six months was again promoted as AEE in his own pay and grade, and was a permanently absorbed in Local Bodies Department, and was posted as AEE at subdivision Batote vide Order number 233, dated 4-10-1996 without any approval of DPC and without the knowledge of all concerned officers of H&UD Department as the order was issued without seeking observations of concerned officers of H&UD Department, as the order was issued by Mr Amit Kushari (IAS) himself the then Principal Secretary to Government H&UD Department ( Photo copy of Government Order is enclosed for your reference) and the other departmental aspirants were given false assurance by the concerned Principal Secretary in the concluding Para of said government order dated 4-10-1996 as under : –
That the Sh. Firdos Ahmed Qazi has been permanently absorbed in local bodies department against 20% direct Quota as prescribed in the recruitment rules with a false assurance was given that the cases of those eligible JEs in lower scale of Rs. 1700/3200 who will be due for promotion will be considered in due course of time against future promotions, vacancies and it is surprising to note that not a single departmental candidate has been promoted till date, the said promotion order number 233/HUD of 1996 dated 4-10-1996 of Sh. Firdos Ahmed Qazi where under he was transferred/ absorbed in the department was challenged by aggrieved engineers vide SWP number 234/97 and whose operative portion of judgement is as under : –
“If the post was to be filled by promotion than those in service and senior to the petitioner should have been considered. If it was to be filled by direct recruitment then the claim of all those candidates who could have applied for open competition should have been considered. Both these things have not happened. Respondent number 4 was initially sent on deputation there after he was made permanent in the department this in a way would be colourable exercise of powers. This petition is accordingly disposed of with the direction to the respondents to reconsider the claim of the petitioner and all other eligible persons. There after the permanent absorption of respondent number 4 would depend upon the result of his reconsideration. Let this be done within a period 4 months from the date a copy of the order passed by this Court is made available to the respondents by the petitioners.”
It will not be out of place to mention here that although Honourable High Court gave clear cut directions to H&UD Department officers, but no appropriate action was taken by the H&UD Department as they surrendered before Mr. Qazi. Keeping in view his political background and money power and the Government without considering the departmental hands they again issued his further promotion order in favour of Mr Firdos Ahmed Qazi vide government order number 209/HUD of 2001 dated 10-9-2001 where under he was placed in regular pay scale of Assistant Executive Engineer in pay scale of Rs. 9000/14100 and with the directions to continue in Local Bodies Subdivision Batote. (photo copy of the said order dated 10-9-2001 is enclosed for your consideration) see Miracle of the case that Mr Qazi was further promoted as Executive Engineer within some period in Local Bodies Department without any post and it was due to then his close relative, the then R&B Minister of J&K government, who transferred a post of XEN from R&B department to the local bodies department for a period of three months and managed his promotion through the then Deputy C.M. in charge Minister of H&UD Department for three months, who happened to be close friend of the then Minister for R&B vide order number 28-HUD of 2010 dated 24-02 -2010 and was posted as Technical Officer to DULBJ. The DULBJ also endorsed the said order in favour of Mr. Qazi vide order number DULBJ/2010/2450-56 dated 02-02-2010 and was regularised as Executive Engineer in Local Bodies Department without any vacancy of the post, Now we have become tired, helpless and mentally frustrated as no one was ready to listen and redress our claim/grievances as Mr Qazi has become XEN since many years and we are still working as JE’s in Local Bodies Department. We have now last hope in your good self and with the hope that if in the Governor Raj, we will not be given justice, then there is only last option for us to commit suicide. Keeping in view above facts it is humbly prayed that a thorough investigation make kindly be made against Mr Firdos Ahmed Qazi through some reliable agencies, who is presently working as XEN in J&K Housing Board Unit-I Jammu, since few months and has accumulated huge movable and non-movable property in Bithindi, Sunjwan Jammu. He has also purchased many plots at Bithindi area and at his hometown Kishtwar, He has also purchased house at airport road Srinagar near Qazipura and flats at Noida and Gurugram at NCR Delhi, which needs Through probe. It is also requested to your good self that Mr Qazi may be demoted to his equivalent post where his batch mates are working on the similar posts and eligible departmental candidate may kindly be promoted against his post. Hope your good self will look into the matter personally and shall issue appropriate his attachment orders in favour of Mr Qazi in H&UD Department till Mr.Qazi is repatriated to his parent department i.e Science and Technology and till outcome of Investigation will be available by the concerned agencies.
