In a significant development, the Supreme Court of India has taken suo motu cognizance of the alleged rape and murder of a trainee doctor at RG Kar Medical College Hospital in Kolkata.
According to livelaw.in, a bench comprising Chief Justice of India DY Chandrachud, Justice JB Pardiwala, and Justice Manoj Misra is set to hear the matter on Tuesday, August 20.
The case, officially titled “In Re: Alleged Rape and Murder of Trainee Doctor in RG Kar Medical College Hospital, Kolkata and related issues,” has drawn national attention due to its shocking nature and the subsequent legal developments.
The incident came to light on August 9 when the body of a post-graduate trainee doctor was discovered in the hospital’s seminar room. Kolkata Police swiftly acted, arresting a civic volunteer the following day in connection with the crime. However, the case took a turn when the Calcutta High Court, expressing dissatisfaction with the local police investigation, directed the Central Bureau of Investigation (CBI) to take over the case on August 13. This decision came in response to petitions filed by one of the victim’s parents and other concerned individuals.
The High Court’s order, delivered by a bench comprising Chief Justice TS Sivagnanam and Justice Hiranmay Bhattacharya, highlighted several concerning aspects of the initial investigation. The court noted the surprising registration of the case as an “unnatural death” and the lack of a formal complaint from the hospital principal, despite the victim being a doctor at the same institution. “The parents of the victim have an apprehension that if the investigation is allowed to continue in this manner, it will derail,” the High Court observed, emphasizing the need for “extraordinary relief” in this case. The Supreme Court’s decision to take suo motu cognizance underscores the gravity of the case and the need for a thorough and impartial investigation.
