Deputy Commissioner Reasi Babila Rakwal has rejected renewal of a Brick Kiln situated in Laiter are of Pouni Tehsil and directed the applicant to stop functioning with immediate effect.
According a communication sent to applicant Titru Ram, Owner of Bhagwati Brick Kiln, Laiter, Pouni, the DC has refused to renew the licence as, the ownership of the Brick Kiln changed in violation of rules. However, the DC has given liberty to the applicant to file for fresh registration.
“Application for renewal of licence of Bhagwati Brick Kiln, Laiter (Doogi), Tehsil Pouni, District Reasi. Wherein you have applied for renewal of Bhagwati Brick Kiln licence on 25-03-2022 for one year (01-04-2022 to 31-03-2023) alongwith copies of Consent Order of J&K Pollution Control Board, receipt of Royalty to BMO-Reasi, copy of filling of GST Return and Original receipt of challan of Rs. 10,000/- under head 0075. Your application for renewal of licence has been examined and it transpires that M/s Bhagwati Brick Kiln at village Laiter, Tehsil Pouni was established in the year 1997 vide order No. 983/0Q dated 18-02-1997 of Tehsildar Reasi and original licence was issued in favour of Sh. Rattan Lal S/o Ram Rakha R/o Shakti Nagar Jammu”, communication read.
It further that the licence was transferred in your favour (Titru Ram son Tapassi Ram resident Village Laiter) by the then Tehsildar Reasi in the year 2005. But, as per the provision of ‘Jammu and Kashmir Brick Kilns (Regulation) Act, 1990″ & “Jammu and Kashmir Brick Kiln (Regulation) Act, 2010” and rules thereunder, there is no provision for transfer of the Brick Kiln licence.
Accordingly, your application for renewal of licence is not considered and you are directed to immediately stop the functioning of “Bhagwati brick kiln situated at village Laiter (Doogi), Tehsil Pouni. Further, you are at liberty to apply for fresh licence as per the provision of Jammu and Kashmir Brick Kiln (Regulation) Act, 2010″and rules thereunder.
