In response to a question raised by MLA Doda regarding allegations of illegal tax collection from drivers on NH-244 by municipalities through road barriers, the government addressed the issue in the assembly.
Government’s Response to Allegations
The government denied the existence of illegal tax collection, stating: “No, Sir. There were some complaints regarding the collection of tax on the National Highway at Kishtwar, Thathri, Doda, and Batote. However, necessary corrective measures have been taken.”
To address these concerns, the Director of Urban Local Bodies, Jammu, issued: Circular No. DULBJ/2025/7558-60 dated 01.03.2025, directing all CEOs/EOs of Municipal Councils/Committees not to collect Adda Tax from vehicles not using any municipal infrastructure. Letter No. DULBJ/2025/6722-25 dated 01.02.2025, instructing all municipal authorities to strictly adhere to the Jammu & Kashmir Municipal Act, 2000, in conjunction with the National Highway (Land and Traffic) Act, 2002, as per High Court directions in WP(C) No. 2543/2019.
Addressing the Parking Facility Concerns
The MLA further inquired why municipalities are not collecting Adda Taxes in exchange for providing proper parking facilities. The government clarified that such taxes should only apply to vehicles using municipal infrastructure, not those merely passing through.
