HC Stays Coercive Action Against Petitioner in Udhampur FIR

The High Court of Jammu & Kashmir and Ladakh at Jammu has restrained police from taking coercive measures against Subash Singh in connection with FIR No. 116/2025, registered at Ramnagar Police Station, Udhampur, under Sections 302 and 506 of the IPC.

Justice M.A. Chowdhary, while hearing CRM(M) No. 904/2025, took note of the petitioner’s contention that the FIR was lodged after an inordinate delay and despite the police inquest having ruled out the aspect of murder. Appearing for the petitioner, Advocate Irfan Khan argued that the registration of the case was unjustified and an abuse of process of law.

The court, after issuing notice to the respondents including the Union Territory of J&K, directed that while investigation in the matter may continue, no coercive action shall be taken against the petitioner till the next hearing, fixed for October 29, 2025. Government Advocate Sumeet Bhatia accepted notice on behalf of UT of J&K an d others. The interim order provides temporary relief to the petitioner as the High Court will further examine the grounds for quashment of the FIR on the next date of hearing.
