Incompetence of BDO Kotranka unable to read order passed by ACD Rajouri in first appeal under RTI Act

The appeal is disposed off with the directions to the Block Development Officers Budhal Old and others to provide the required information to the appellant free of cost within 7 days from passing of this order. Any delay/laxity in providing the information to the appellant you will be personally responsible and action as warranted under RTI Act. 2005 shall be initiated against the concerned.

The incompetence of block development officer (BDO) Kotranka block could be gauged from the fact that he could not understand the order passed by the Assistant Commissioner Development (ACD), in first appeal under RTI Act for finishing information to applicant free of cost within a week.

ACD Rajouri passed an order vide no ACDR/RTI-Ist appeal/ 1815-17, dated 22/07/2023 directing BDO Kotranka (Budhal old) and other BDOs to providing information sought by the applicant within a week i.e. by 29/07/2023, but till 10/08/2023 none of BDO acted yet. When the applicant telephonically contacted most of the BDOs said reply has been ready and being dispatched, but BDO Kotranka, has a different interpretation of the order passed by the ACD and implemented by his other counterparts.

“In the order it has been said that applicant has not been present so reply so complaint is being disposed off”, the BDO said, which is true, but he did not bother to read the complete order.

“In the matter of 1st appeal under RTI Act. 2005 in the office of Assistant Commissioner Development Rajouri as Ist appellate Authority filed by Sh. Avinash Kumar PIO’s Block Development Officers Budhal Old (Kotranka) for not providing the required information to the applicant within prescribed period of 30 days. Whereas the appeal was fixed for hearing on different dates i.e. 22-06-2023, 03-07-2023 and 18-07-2023.

In view of the above, appeal is disposed off with the directions to BDO’s Budhal old and others to provide the required information to the appellant free of cost within 7 days from passing of this order. Any delay/laxity in providing the information to the appellant you will be personally responsible and action as warranted under RTI Act. 2005 shall be initiated against the concerned.
