A Division bench of the High court comprising Justice Sindhu Sharma and Justice Vinod Chatterji koul today stayed the impugned Judgement of the single bench whereby the Single Bench yesterday in a writ petition cancelled the ongoing exams of Sub inspectors as well of JE civil with an observation that blacklisted company has been given the contract by the JKSSRB coupled with also directed the government to inquire into the irregularities and illegalities of JKSSRB by holding inquiry headed by not less than a retired High court Judge.
Aggrieved of Judgement passed by the Single Judge, Advocate General of UT of JK D. C Raina filed letters patent appeal (LPA) and vociferously argued before the Division bench that Single Judge has passed an impugned judgement in contravention of rule 14 and rule 15 of the writ proceedings rules and cancelled the entire selection process to the post of Sub inspectors and Junior Engineer Civil.
The Division bench stayed the impugned Judgement and call for the record from the writ Court. Meanwhile, JKSSRB has been directed to proceed ahead for the selection process for the post of Junior Engineer (Jal Shakti department ) and civil and Sub inspectors (Home department. However, the result of the same shall await orders from the court. The next date of the hearing is fixed for 2.2.2023.
