‘Information regarding service record of Er Firdous Qazi concealed by CPIO’

Mending the mistake of CPIO Surinder Kumar of concealing information under RTI Act, the First Appellate Authority (FAA), Joint Commissioner, Jammu Municipal Corporation (JMC) directed former the furnish the information within 15 days. Hearing for first appeal filed by the appellant held on April 16, 2022, the FAA passed his order on May 9, 2022.

The appellant in an RTI on January 20, 2022 before the CPIO JMC had detail of service record i.e. copy of appointment letter, copy selection list, and time to time promotions given to Mr Firdous Ahmed Qazi, now Executive Engineer, JMC. The CPIO in his reply concealing the fact replied that the officer was sent on deputation in JMC by the Public Works (R&B) Department, so the information sought was not available with the JMC. Aggrieved incorrect reply, appellant knocked the door of FAA JMC and filed First Appeal under RTI Act.

The appellant also provided some documents to prove his claims that the officer was not sent on deputation, but repatriated to JMC from JK Hosing Board for his encadrement in JMC. Going through the supporting documents provided by the appellant, the FAA, JMC found the appeal genuine and directed the CPIO to provide the information within the 15 days. However, the FAA also allowed the appellant to appeal before the Central Information Commission, the appellant, if deemed necessary. Meanwhile, waiting for 113 days when he filed RTI application before CPIO i.e. January 20, 2022, the appellant on May 13, 2022 had also filed second appeal before the Central Information Commission, in larger public interest.

The appellant had sought detail regarding the below mentioned questions: Kindly provide detail regarding appointment of and time to time promotion given to Mr Firdous Ahmad Qazi, Executive Engineer, recently joined the corporation after his repatriation from the J&K Housing Board vide Govt order no. 150-JK(HUD) of 2021, dated 11/11/2021.

a.      Certified copy of initial appointment order Mr Firdous Ahmed Qazi, in government services.

b.      Certified copy of list of the selected candidates including Mr Firdous Ahmed Qazi, now Executive Engineer at the time of his appointment.

c.      Name of agency conducted recruitment, number of posts advertised, date of interview/selection be furnished separately.

d.      Time to time promotions given to Mr Firdous Ahmed Qazi, Executive Engineer, since his joining of government services to till date. Also provide service detail of Mr Firdous Ahmed Qazi in different capacity from his joining to till date.
