Implementation of Advocate Welfare fund act 2001 in J&K lawyers hail the decision

Finally a long wait comes to an end for the Lawyer’s fraternity of Jammu and Kashmir with the implementation of Advocate welfare fund 2001.This Advocate welfare fund 2001 already in vogue across the whole Country but in Jammu and Kashmir this act was not implemented resultant there in lawyers fraternity faced insurmountable hardships on account of Non Implementation of this Advocate Welfare act 2001.

After the abrogation of Article 370 several laws which were not in force in Jammu and kashmir has been invoked due to the reorganization act 2019 as such this Advocate Welfare act 2001 also been came into force which is a big achievement for the lawyer’s fraternity. 

With the implementation of this Advocates welfare fund 2001 this will go a long way in helping the lawyers fraternity from financial distress or the crises. 

In this advocate welfare fund act 2001 gives the lawyer’s financial assistance who are facing dire straits in terms of ailments or could not able to do any sort of practise by which they could able to earn their livelihood. This is much needed act for the lawyer’s fraternity for the reason in this profession one don’t have any retiral benefits and some sort of security when the lawyer’s in their old age unable to do work as such this advocate welfare fund act provide financial assistance which would relieve of the hardships to the lawyer’s who otherwise have to gone through tough phase. 

In order to implement the Advocate welfare fund act 2001,Government has established the Jammu and Kashmir Advocates Welfare fund and also established Jammu and Kashmir Advocate welfare Fund trustee act headed by Advocate General of UT of Jammu and kashmir,Registrar general and Law secretary. Two advocates nominated by the government and one public prosecutor as it’s members. 

The trusteeship committee chaired it’s first meeting on 13.10.2022 where in it was decided to frame rules and regulations as how to implement the Advocates welfare fund act 2001.

The advocates welfare fund  inter alia be used for the grant to the member of the fund in case of serious health problems, payment of fixed amount on cessation of and in case of death of , to his nominee or the legal heir, medical and educational facilities for the members of their dependents, purchase of the books and for establishing  facilities for the advocates.
